Welcome to Kenya Ni Home ("Kenya Ni Home", "we", "us" or "our"). These Terms of Service govern your use of kenyanihome.com, its news content, newsletters, contact channels, jobs portal, marketplace and related services (together, the "Services").
By accessing or using the Services, you confirm that you have read, understood and agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
1. Who we are and how to contact us
Kenya Ni Home is a Kenyan digital news and information platform. For editorial queries, corrections, legal notices, marketplace concerns or questions about these Terms, contact us at newsroom@kenyanihome.com or call 0717431488. Our stated location is Nairobi, Kenya.
2. Changes to these Terms and the Services
We may change these Terms, features or content from time to time. The current version will be posted on this page with a revised "Last updated" date. Your continued use after a change takes effect means you accept the updated Terms. If a change materially affects a paid service, we will provide notice where reasonably practicable.
3. Eligibility and acceptable use
You may use the Services only for lawful, personal and non-commercial purposes unless we give you written permission otherwise. You must not:
break any applicable law or regulation;
interfere with, disrupt, probe, scrape, overload or attempt to gain unauthorised access to the Services, accounts, servers or data;
use bots, automated tools or data-mining methods to copy, archive, index or commercially exploit our content without permission;
post, submit or transmit content that is false, defamatory, unlawful, hateful, threatening, obscene, discriminatory, invasive of privacy, infringing, misleading or spam;
impersonate another person or organisation, misrepresent an affiliation, or use the Services to commit fraud;
upload malware, harmful code or material that could damage or impair the Services; or
use our name, logo or content in a way that suggests endorsement without written approval.
We may restrict, suspend or terminate access where we reasonably believe these Terms have been breached or where needed to protect users, the platform or the public.
4. Editorial content and accuracy
Kenya Ni Home publishes news, commentary, analysis, features, opinion and third-party material. We aim for accuracy, fairness and timely correction, but news can change quickly and errors may occur. Content is provided for general information only and may be updated, corrected, removed or archived without notice.
Views expressed by writers, contributors, interviewees, commenters, advertisers or other third parties are their own and do not necessarily represent Kenya Ni Home’s views. Republishing, linking to or reporting on a statement does not mean we endorse it.
If you believe a story contains a significant factual error, please email newsroom@kenyanihome.com with the story URL, the disputed statement, supporting information and your contact details. We will review credible requests, but editorial decisions remain with Kenya Ni Home.
5. No professional advice
Our content is not legal, medical, financial, investment, tax, employment, political, security or other professional advice. Do not rely on it as a substitute for advice from a qualified professional who understands your circumstances. Any action you take based on information on the Services is at your own risk.
6. Intellectual property and permitted sharing
Unless otherwise stated, Kenya Ni Home and its licensors own all rights in the Services, including articles, headlines, photographs, graphics, videos, logos, designs, databases and software. These materials are protected by copyright, trade-mark and other laws.
You may share links to our publicly available stories and make limited personal, non-commercial use of them, provided you keep all notices intact and do not alter the material. You may not reproduce, republish, sell, syndicate, distribute, translate, create derivative works from, or commercially exploit any material without our prior written consent, except where permitted by law.
To request permission, email newsroom@kenyanihome.com. If you believe material on the Services infringes your intellectual-property rights, send us the relevant URL, a description of the work, evidence of your authority and your contact details.
7. User submissions, comments and story tips
You remain responsible for any comment, story tip, photograph, video, document, job listing, product listing or other material you submit ("User Content"). You confirm that you have the right to submit it, that it is accurate to the best of your knowledge, and that its use will not violate anyone’s rights or the law.
By submitting User Content, you grant Kenya Ni Home a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, reproduce, edit, adapt, publish, distribute, display and use it in connection with operating, promoting and improving the Services. This licence ends when the material is deleted from our systems, except where retention is necessary for legal, operational, archival or dispute-resolution reasons, or where the material has already been used in published reporting.
We may, but are not obliged to, review, moderate, edit, refuse or remove User Content. Do not submit confidential information, material you do not have permission to share, or content that could place you or another person at risk. News tips may be investigated before publication and cannot be guaranteed confidentiality unless we expressly agree to it in writing.
8. Newsletter and communications
If you subscribe to our newsletter, you consent to receive the communications you request. You may unsubscribe at any time through the unsubscribe link in an email or by contacting us. Marketing communications will be handled in accordance with our Privacy Policy and applicable law.
9. Advertisements, sponsored content and external links
The Services may contain advertisements, sponsored content, affiliate links or links to external websites. Paid or sponsored editorial material will be identified where appropriate. We do not control third-party websites, products, services, offers or content and are not responsible for them. Your dealings with advertisers and third parties are solely between you and them.
10. Marketplace: Advertised Products
The marketplace helps businesses advertise products and services; unless we expressly state otherwise in writing, Kenya Ni Home is not the seller, supplier, agent, payment processor, delivery provider or guarantor of any listed item.
Buyers and sellers are solely responsible for verifying identities, business credentials, product descriptions, pricing, availability, quality, delivery arrangements, payment terms, warranties, taxes, licences and compliance with law. A listing, badge, advertisement or approval on the marketplace is not a guarantee that a seller or product is safe, legitimate, available or suitable.
Sellers must provide accurate, lawful and non-infringing listings and must not advertise prohibited, counterfeit, stolen, unsafe or misleading goods or services. We may reject, edit, suspend or remove listings at our discretion. Kenya Ni Home is not responsible for losses, disputes, refunds, chargebacks, delivery failures or harm arising from a marketplace transaction. Report suspected fraud or unsafe listings immediately to newsroom@kenyanihome.com.
11. Jobs portal
The jobs portal connects jobseekers and employers but does not guarantee employment, interviews, candidates, salary information, employer conduct or the accuracy of any vacancy. Employers are responsible for the legality, accuracy and fairness of their listings and hiring processes. Jobseekers are responsible for the information they provide and for independently verifying an employer and opportunity before applying, disclosing personal information, paying money or accepting an offer.
Never pay a prospective employer or recruiter unless you have independently verified that the charge is lawful and legitimate. Kenya Ni Home is not a party to employment relationships and is not liable for recruitment decisions, workplace conduct, fraudulent listings or communications between users.
12. Paid features, advertising and refunds
Where we offer paid advertising, promotions, subscriptions or other paid features, the applicable price, duration, placement and any additional terms will be shown before payment. Unless a specific written agreement says otherwise, fees are payable in advance and are non-refundable once a campaign, listing, subscription period or service has begun. We may reject advertising or promotional material that conflicts with our editorial standards, these Terms or applicable law.
Nothing in this section limits any non-excludable consumer rights you may have under applicable law.
13. Privacy and data protection
Our collection and use of personal data is explained in our Privacy Policy. By using the Services, you acknowledge that we may process personal data as described there. We seek to handle personal data in line with applicable Kenyan data-protection law, including the Data Protection Act, 2019. You may contact us using the details above regarding your personal data or privacy concerns.
14. Service availability and security
We work to keep the Services available and secure, but do not guarantee uninterrupted, error-free, secure or virus-free access. We may carry out maintenance, change features, suspend or discontinue all or part of the Services at any time. You are responsible for using appropriate security protections, including updated devices, software and passwords.
15. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory. We do not warrant that content will be complete, accurate, current, uninterrupted, secure, suitable for a particular purpose or free from harmful components.
16. Limitation of liability
To the maximum extent permitted by law, Kenya Ni Home, its owners, officers, editors, contributors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive losses; loss of profits, data, goodwill or opportunity; or losses arising from use of, inability to use, reliance on, or transactions made through the Services.
Where liability cannot lawfully be excluded, our total liability for a claim connected with the Services will not exceed the amount you paid directly to Kenya Ni Home for the relevant paid service in the 12 months before the claim arose, or KES 1,000 if you did not make such a payment. This does not exclude liability that cannot be excluded under Kenyan law.
17. Indemnity
You agree to indemnify and hold harmless Kenya Ni Home and its owners, officers, editors, contributors and service providers from claims, losses, liabilities and reasonable costs arising out of your User Content, your breach of these Terms, your unlawful use of the Services or your violation of another person’s rights.
18. Governing law and disputes
These Terms are governed by the laws of Kenya. Before starting formal proceedings, you agree to contact us and give us a reasonable opportunity to resolve the matter informally. Subject to any mandatory consumer-protection rules, disputes connected with these Terms or the Services will be submitted to the courts of Kenya.
19. General terms
If any part of these Terms is found unenforceable, the remaining parts will continue in effect. Our failure to enforce a provision is not a waiver of that provision. You may not transfer your rights or obligations under these Terms without our consent. These Terms, together with the Privacy Policy and any applicable paid-service terms, form the entire agreement between you and Kenya Ni Home regarding the Services.
